A BILL to amend article ten, chapter seventeen-a of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
sixteen, relating to establishing the emergency medical
services training and equipment fund.
Be it enacted by the Legislature of West Virginia:
That article ten, chapter seventeen-a of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
sixteen, to read as follows:
ARTICLE 10. FEES FOR REGISTRATION, LICENSING, ETC.
§17A-10-16. Fee for emergency medical services training and
equipment fund.
(a) An additional fee of two dollars per year shall be
charged and collected at the time of registration of vehicles of
Class A, Class B, Class C, Class E, Class G, Class H, Class
J and Class K. All funds collected pursuant to this subdivisionshall be paid into the state treasury and shall be set aside as
a special fund to be used for emergency medical service purposes
and for no other purpose.
(b) Fifty percent of the funds collected by the additional
two dollars per year charged at the time of registration of the
above classes of vehicles shall be utilized for operational costs
of ambulance services under the jurisdiction of county
commissions or legally appointed ambulance authorities. Such
operational funds are to be awarded by the office of emergency
medical services in the state bureau of public health to such
ambulance services on the basis of the number of medicaid
certified vehicles included in each county ambulance allocation
plan. Operational funds may be used for maintenance of vehicles,
replacement parts, repairs or other costs directly related to
ambulances. Funds are to be awarded as reimbursement for costs
actually incurred except in documented circumstances where
financial hardship prevents payment in advance of receiving
reimbursement.
(c) The remaining fifty percent of funds collected from the
additional two dollars per year charged at the time of
registration of the above classes of vehicles shall be used by
the office of emergency medical services in the state bureau of
public health for matching purposes in the purchase of
ambulances, ambulance and rescue equipment and in the training of
providers of emergency medical services.
NOTE: The purpose of this bill is to provide funding for
upgrading of emergency medical services and equipment across the
state.
